Whether the goal is to support an insurance claim, track construction progress, prepare a restoration estimate, market a property, or preserve a permanent record of site conditions, the right documentation platform can dramatically improve accuracy, communication, and workflow efficiency.</span></p><p style="text-align:justify;"><span style="font-size:18px;">But for lawyers, adjusters, contractors, consultants, experts, and claim professionals, the real value is even bigger than convenience.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The real value is leverage!</span></p><p style="text-align:justify;"><span style="font-size:18px;">If you want faster settlements, give me better cases.</span></p><p style="text-align:justify;"><span style="font-size:18px;">I wrote this for the public adjusters, contractors, estimators, engineers, and other professionals who work Texas property insurance claims alongside policyholders. Before I served policyholders as a lawyer, I worked on the other side of the tape measure as a contractor, roofer, home inspector, and adjuster, so I know what goes into a claim file and what happens to it later.</span></p><p style="text-align:justify;"><span style="font-size:18px;">One clarification up front. When I say “give me better cases,” I am talking about the quality of the evidence in the files I see when a policyholder decides to hire a lawyer. The policyholder always chooses their own lawyer. Texas ethics rules generally prohibit lawyers from paying or giving anything of value to non-lawyers for soliciting or referring clients (Texas Disciplinary Rule of Professional Conduct 7.03(e)). This article is about building proof, not about who sends what to whom.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A better case is not just a bigger demand. It is a clearer demand. It is a demand supported by organized photographs, measurements, reports, timelines, floor plans, 3D models, annotations, estimates, and visual proof. It is a case that makes the loss easier to understand, harder to deny, easier to value, and more dangerous to defend.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A weak case invites delay. A confusing case invites denial. A poorly documented case invites lowball offers. But a visually documented, measured, time-stamped, organized case changes the conversation. It tells the carrier, the adjuster, the defense lawyer, the mediator, and ultimately the jury: this is not speculation. This is what happened. This is what was damaged. This is how we know. This is what it costs to fix.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Modern documentation technology is not just a field tool. It is a litigation tool. Each tool approaches the same broad problem from a different angle. Some specialize in exterior measurements. Others focus on immersive 3D tours, 360-degree walkthroughs, photo timelines, or fast floor plan creation. The key is not simply choosing the most advanced platform. The key is choosing the tool that best matches the work being performed.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Why Documentation Technology Matters</span></h2><p style="text-align:justify;"><span style="font-size:18px;">In construction, restoration, insurance, and real estate, documentation is often the difference between clarity and conflict. A well-documented project creates a reliable visual record of what existed, what changed, when it changed, and who had access to the information. That record can reduce disputes, accelerate estimates, improve client communication, and support better decision-making.</span></p><p style="text-align:justify;"><span style="font-size:18px;">For insurance claims, documentation tools help establish the scope and condition of damaged property. For real estate professionals, 3D tours and floor plans can improve buyer engagement and reduce unnecessary in-person showings. The central value of these tools is simple: they convert field observations into organized, shareable, and often measurable digital evidence.</span></p><p style="text-align:justify;"><span style="font-size:18px;">For litigation, that matters because cases are won, lost, valued, delayed, and settled based on evidence. A claim file that depends on scattered phone photos, vague estimates, and after-the-fact explanations gives the opposing side room to argue. They can say the damage was pre-existing. They can say the estimate is inflated. They can say the scope is unclear. They can say the contractor missed something. They can say the policyholder cannot prove what was damaged, when it was damaged, or why it needs to be replaced.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Better documentation closes those gaps.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It turns a claim from a story into a record.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It gives the lawyer the ability to say: here is the roof, here are the elevations, here is the room-by-room walkthrough, here is the moisture path, here is the timestamped photo timeline, here are the measurements, here is the floor plan, here is the estimate, here is the report, and here is the visual evidence that ties it all together. And most importantly here is the professional that put this entire package together and his justification for the demand.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is how technology creates pressure.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">The Settlement Problem: Opposing Counsel Settles Faster When the Risk Is Clear</span></h2><p style="text-align:justify;"><span style="font-size:18px;">The uncomfortable truth in claims and litigation is this: the other side does not begin by assuming you are telling the truth.</span></p><p style="text-align:justify;"><span style="font-size:18px;">They may never say it out loud. They may dress it up in polite language. They may call it “evaluating coverage,” “investigating causation,” “reviewing scope,” or “assessing damages.” But functionally, they are treating your claim as unproven, your estimate as inflated, your client as self-interested, and your version of events as something to be tested, minimized, or rejected.</span></p><p style="text-align:justify;"><span style="font-size:18px;">In other words, they think you are lying.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Whether they actually believe that in their heart is irrelevant. Their belief is not the point. Their posture is the point. The claim is not paid because you insist it is valid. The case is not settled because you announce it is strong. Opposing counsel does not recommend real money because you are confident.</span></p><p style="text-align:justify;"><span style="font-size:18px;">They settle when the risk of continuing to deny, delay, or undervalue the claim becomes clearer than the risk of paying it. Your job is to make disbelief unreasonable. That is where documentation technology changes the case. Documentation helps a layperson understand that a local jurisdiction may require a portable toilet on the jobsite, that the job is complex enough to justify a general contractor, or why removing the sink and appliances may support a claim for additional living expenses (ALE) under the policy.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A carrier, defense lawyer, or claim representative evaluating a loss is not asking, “Do they sound sincere?” They are asking harder, colder, more practical questions:</span></p><ul><li><span style="font-size:18px;">Can the plaintiff prove the damage?</span></li><li><span style="font-size:18px;">Can the plaintiff prove the scope?</span></li><li><span style="font-size:18px;">Can the plaintiff prove causation?</span></li><li><span style="font-size:18px;">Can the plaintiff connect the estimate to the actual property conditions?</span></li><li><span style="font-size:18px;">Can the plaintiff explain the photographs, measurements, and repair methodology in a way a jury will understand?</span></li><li><span style="font-size:18px;">Will their expert have something concrete to rely on?</span></li><li><span style="font-size:18px;">Will our expert look unreasonable if he ignores it?</span></li><li><span style="font-size:18px;">Will our adjuster look careless if she failed to consider it?</span></li><li><span style="font-size:18px;">Will our denial look unfair when placed next to the actual visual record?</span></li><li><span style="font-size:18px;">And most importantly, what will a jury think?</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">That is the battlefield.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Ambiguity is the defense’s safest hiding place. If the facts are scattered, they can call the claim unclear. If the photographs are disorganized, they can call the record incomplete. If the measurements are vague, they can attack the estimate. If the scope is not visually tied to the damage, they can separate price from proof. If the timeline is messy, they can suggest the loss was exaggerated, pre-existing, unrelated, or developed later.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The stronger the documentation, the less room they have to maneuver.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Modern documentation tools compress ambiguity. They take the raw material of a claim — photographs, measurements, diagrams, walkthroughs, floor plans, timestamps, geotags, annotations, reports, and estimates — and turn it into a coherent evidentiary record. They make the property easier to understand, the damage easier to see, the estimate easier to defend, and the denial harder to justify.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That matters because settlement is not charity. Settlement is risk transfer.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Opposing counsel settles faster when the file gives them something persuasive to report to the carrier. The adjuster pays more when the evidence makes continued resistance look dangerous. A mediator can move money when the plaintiff’s presentation is organized enough to show trial risk. A jury can punish denial when the evidence makes the defense look unreasonable.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Technology does not win the case by itself. It does something more practical: it gives the lawyer a better case to try, a better case to mediate, and a better case to settle.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A well-documented file can be used at every stage of the dispute. It supports the claim submission. It strengthens the pre-suit demand. It anchors mediation. It prepares experts. It sharpens depositions. It becomes the foundation for trial exhibits. It gives the lawyer the ability to say, calmly and repeatedly:</span></p><p style="text-align:justify;"><span style="font-size:18px;">You do not have to take my word for it. Look at the property. Look at the timeline. Look at the measurements. Look at the photographs. Look at the model. Look at the floor plan. Jurors do not think like adjusters, estimators, contractors, engineers, or lawyers. They need to see the story. Let me say that again, they need to see the story. They do not want to hear your explanation, they want to relive the event through your eyes to understand.</span></p><ul><li><span style="font-size:18px;">What did you see?</span></li><li><span style="font-size:18px;">What did you smell?</span></li><li><span style="font-size:18px;">What did you hear?</span></li><li><span style="font-size:18px;">What did you feel?</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">Your pictures cannot capture the distraught homeowner turning to you for help.</span></p><ul><li><span style="font-size:18px;">Your Xactimate does not capture the smell of mold and that feeling in your lungs when you know it is there.</span></li><li><span style="font-size:18px;">Your photo sheet cannot demonstrate the flashing electrical, and the buzzing of a light caused by water intrusion.</span></li><li><span style="font-size:18px;">None of it will capture the increased humidity or the uncomfortableness of a home compromised by water intrusion.</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">They need orientation.</span></p><p style="text-align:justify;"><span style="font-size:18px;">They need sequence.</span></p><p style="text-align:justify;"><span style="font-size:18px;">They need confidence that the evidence is real, organized, and fair.</span></p><p style="text-align:justify;"><span style="font-size:18px;">THEY NEED THE STORY!</span></p><p style="text-align:justify;"><span style="font-size:18px;">And not the way you tell it verbally because you are boring me even thinking about how good you can explain it.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A 3D model, 360-degree walkthrough, annotated photo report, exterior measurement model, or floor plan can help jurors understand the property in a way that words alone cannot. Instead of asking jurors to imagine the layout, the slope, the room, the water path, the roof condition, or the repair scope, the lawyer can show it.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That matters because visual evidence reduces cognitive load. It helps jurors connect testimony to reality. It also helps experts explain their opinions in a way that feels grounded rather than abstract.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A jury presentation built around modern documentation can answer the questions jurors naturally have:</span></p><ul><li><span style="font-size:18px;">Where are we on the property?</span></li><li><span style="font-size:18px;">What am I looking at?</span></li><li><span style="font-size:18px;">When was this photo taken?</span></li><li><span style="font-size:18px;">How do I know this is the same area?</span></li><li><span style="font-size:18px;">What was damaged?</span></li><li><span style="font-size:18px;">How extensive was it?</span></li><li><span style="font-size:18px;">How does this connect to the estimate?</span></li><li><span style="font-size:18px;">Why is this repair necessary?</span></li><li><span style="font-size:18px;">Why is the opposing explanation incomplete?</span></li><li><span style="font-size:18px;">What did it look like before and after the repair?</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">When the evidence is visual, organized, and measurable, the case becomes easier to believe.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That does not mean technology replaces testimony, experts, estimates, or legal argument. It means technology gives those things a stronger foundation.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Hover: Best for Exterior Measurements and Insurance-Driven Workflows</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Hover is especially strong for exterior property documentation. It uses guided smartphone photography to create 3D property models and measurement reports for roofs, siding, windows, and other exterior components. This makes it particularly useful for roofing contractors, insurance professionals, and exterior restoration teams.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Its biggest advantage is that it turns ordinary field photos into structured measurement outputs. Rather than relying only on manual measurements or ladder-based inspections, users can collect photos from the ground and receive a detailed model and report. That workflow can support estimating, material ordering, insurance claims, and property assessments.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Hover is a strong fit when the primary question is: “What are the exterior dimensions, quantities, and property features that need to be estimated or documented?”</span></p><p style="text-align:justify;"><span style="font-size:18px;">From a litigation and settlement standpoint, Hover can be used to strengthen exterior claims by giving the demand package a measurement backbone. In roof, siding, window, gutter, elevation, and exterior envelope disputes, one common defense tactic is to challenge quantities. You may lose a square or two, or gain a square or two, but independent technology will often carry more weight than your testimony alone.</span></p><p style="text-align:justify;"><span style="font-size:18px;">My prediction is that this kind of measurement technology will keep gaining ground, and I would not be surprised to see estimating platforms such as Xactimate integrate it more deeply or build comparable tools of their own. Xactimate has been developing 360-degree walkthroughs and interior measurements, but in my experience those features are not yet perfect.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Docusketch: Best for Interior Restoration and 360-Degree Documentation (My Personal Favorite)</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Docusketch is built around interior documentation (but it does exteriors pretty dang well). It uses 360-degree photos and walkthroughs to create detailed floor plans, markup-enabled views, and chronological project records. This makes it highly relevant for restoration contractors, property managers, construction firms, and insurance adjusters.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Its value is strongest in water mitigation, fire restoration, interior damage assessment, and other situations where room-by-room and even exterior documentation matters. A 360-degree capture can preserve a more complete visual record than traditional still photography. Instead of wondering whether a photo captured the correct corner, wall, or ceiling condition, users can revisit the virtual walkthrough and inspect the space from multiple angles.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Docusketch is a strong fit when the primary question is: “How do we document interior conditions thoroughly and generate usable floor plans or restoration records?”</span></p><p style="text-align:justify;"><span style="font-size:18px;">For litigation, Docusketch is powerful because interior claims often turn on layout, spread, sequence, and scope. Water losses, fire losses, mold-related repairs, mitigation disputes, and rebuild claims require room-by-room clarity. A written estimate may list line items, but a 360-degree walkthrough helps explain why those line items exist. Docusketch also offers before and after technology which is useful to demonstrate a repair or current conditions.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Docusketch can help opposing counsel, a mediator, or a jury understand how damage moved through a structure. It can show affected rooms, walls, flooring, ceilings, contents, openings, transitions, and repair zones. It can also help rebut the claim that the scope was exaggerated after the fact. As I understand it, Docusketch uses the known height of its tripod (5’3” on the setup I use) as a reference for its measurements. It can be wrong, and in my experience the company has worked to correct errors when I raised them. It is not cheap (the entry-level plan was roughly $199 per month when I wrote this, so check current pricing), but for me the time savings make it worth it. In an open room, a single capture may give Docusketch enough to produce a sketch and an ESX file, but more captures are better.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Matterport: Best for Immersive 3D Digital Twins</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Matterport is one of the most recognized platforms for creating immersive digital twins. It is widely used in real estate, commercial property management, architecture, engineering, construction, and insurance documentation. Its core strength is the creation of realistic, navigable 3D spaces.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Matterport is especially useful where presentation quality and spatial understanding are important. A buyer, client, adjuster, expert, or project stakeholder can virtually walk through a property and better understand the space without being physically present. Matterport also supports schematic floor plans, measurement tools, 3D outputs, and integrations with platforms used in design and building workflows.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Matterport is a strong fit when the primary question is: “How do we create an immersive, professional digital twin of this property or space?”</span></p><p style="text-align:justify;"><span style="font-size:18px;">Matterport’s litigation value is obvious: it creates context. In complex property cases, jurors and opposing counsel may struggle to understand the layout, the relationship between rooms, the size of the property, the path of damage, or the relationship between visible conditions and expert opinions.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A Matterport model gives the factfinder a way to enter the property.</span></p><p style="text-align:justify;"><span style="font-size:18px;">For high-value claims, commercial losses, large residential losses, construction defect cases, premises disputes, or cases where the condition of the property is central, Matterport can become the visual anchor of the case.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Instead of showing isolated photographs, the lawyer can move through the space, pause at key areas, connect the scene to expert testimony, and explain the repair scope in context.</span></p><p style="text-align:justify;"><span style="font-size:18px;">In settlement negotiations, that can increase pressure because the opposing side must evaluate how the property will actually look to a jury. Instead of sending a disorganized file dump and hoping the expert can make sense of it, the lawyer can provide a structured evidentiary package: walkthrough, timeline, measurements, floor plan, photographs, videos, estimate, prior reports, and key disputed issues. The expert gets a cleaner file. The lawyer gets fewer follow-up questions. The report gets completed faster. The opinions become easier to defend.</span></p><p style="text-align:justify;"><span style="font-size:18px;">This is why experts and engineers should not resist documentation technology. They should demand it.</span></p><p style="text-align:justify;"><span style="font-size:18px;">If an expert is expected to help build the case, they need the tools and records that allow them to do that job well. If an engineer is expected to explain causation, they need more than a handful of photos taken from unknown angles. If an estimating expert is expected to defend scope, they need measurements, room context, and visual support. If a contractor is expected to justify a repair plan, they need documentation that connects the work to the damage.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The goal is not to replace expert judgment.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The goal is to give expert judgment a stronger foundation.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Technology does not make the expert credible by itself. But it gives the expert a record that is easier to understand, easier to verify, easier to explain, and harder for the other side to dismiss.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is how documentation technology helps experts move faster, write better reports, and build better cases.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Thermal Imagery: Showing What the Eye Cannot See</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Not all damage announces itself in a photograph.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Some of the most important evidence in a property case is hidden, subtle, or dismissed because it is not immediately visible to the naked eye. A room can look clean, painted, and finished while the building materials underneath are telling a different story.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is why thermal imagery belongs in the documentation conversation.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A regular photograph captures what something looks like. A thermal image helps capture what the surface is doing. It can reveal temperature anomalies, possible moisture patterns, insulation issues, air movement, and hidden conditions that may not be visible in standard photos. It does not replace destructive testing, moisture readings, engineering analysis, or expert judgment. But it gives the expert another layer of information to evaluate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">And in litigation, that matters.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The person taking the thermal images may not be qualified to offer a final causation opinion. They may not be an engineer. They may not be the expert who ultimately testifies. But if the images are taken properly, with a calibrated thermal camera, preserved with the file, and tied to the location, date, and inspection conditions, the data can still become valuable. The expert can review it. The engineer can interpret it. The lawyer can use it to show why further investigation was reasonable. The jury can see why the damage was not imaginary just because it was not obvious in a normal photograph.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is the key distinction.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The field professional may not be testifying, “This proves the cause of loss.”</span></p><p style="text-align:justify;"><span style="font-size:18px;">The field professional may simply be preserving the observation: this is what the camera recorded at this location, at this time, under these conditions.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Then the expert can explain what that data means.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That can be powerful when the opposing side tries to argue there was “no visible damage.” Visible to whom? Under what method of inspection? With what tools? At what point in time?</span></p><p style="text-align:justify;"><span style="font-size:18px;">A wall covered in thick paint may hide staining. A ceiling may conceal moisture until it is too late. Flooring may appear intact while the thermal pattern suggests a problem underneath. A standard photo may show a normal room. A thermal image may show a reason to investigate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That helps tell the tale.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Thermal imagery gives the lawyer a way to show the jury that the absence of obvious surface damage is not the same as the absence of damage. It helps explain why a contractor, adjuster, or expert kept looking. It helps connect the ordinary photo to the hidden condition. It gives the expert a visual bridge between what the room appeared to be and what the building materials may have been experiencing.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Used correctly, thermal imagery can strengthen the file in several ways.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It helps identify areas requiring further testing.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It helps document conditions before repairs, demolition, drying, or remediation change the scene.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It helps experts evaluate whether observed patterns are consistent with moisture intrusion, air leakage, insulation defects, or other building conditions.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It helps rebut the argument that the claim was exaggerated simply because the damage was not obvious in a normal photograph.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It helps a jury understand hidden damage without asking them to take the lawyer’s word for it.</span></p><p style="text-align:justify;"><span style="font-size:18px;">But thermal imagery must be handled carefully. A thermal camera is not a magic truth machine. It does not automatically prove moisture. It does not automatically prove causation. It does not replace moisture meters, invasive investigation, laboratory testing, engineering analysis, or a qualified opinion. A thermal image shows temperature differences. The meaning of those differences depends on context.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is why the process matters.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Use a calibrated camera. Preserve the original files. Keep the metadata when possible. Document the room, wall, ceiling, or exterior location where the image was taken. Pair the thermal image with a standard photograph of the same area. Record relevant conditions, including recent weather, HVAC status, drying equipment, sunlight exposure, and inspection timing when those facts matter. Then give the expert a clean record to interpret.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is how thermal imagery becomes useful evidence instead of just a colorful picture.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The goal is not to have every field person pretend to be an engineer. The goal is to preserve data so the engineer, consultant, or expert has something meaningful to analyze. A calibrated thermal image, properly captured and organized, can help the expert move faster, ask better questions, target the right areas, and explain the hidden part of the loss more persuasively.</span></p><p style="text-align:justify;"><span style="font-size:18px;">In claims and litigation, hidden damage is often where the fight lives.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Thermal imagery helps bring that fight into view.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Moisture Meter Readings: Capturing Evidence Before It Disappears</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Moisture is temporary evidence.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is what makes it so important, and that is what makes it so dangerous to ignore. Water does not stay in the same place forever. Materials dry. Staining gets painted over. Flooring is removed. Drywall is cut out. Dehumidifiers run. Fans move air. A room that was wet on the day of inspection may look normal by the time the carrier sends an engineer, the defense hires an expert, or the case reaches litigation.</span></p><p style="text-align:justify;"><span style="font-size:18px;">If the moisture was not documented when it was present, the evidence may be gone.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is why moisture meter readings are not just field notes. They are case evidence.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A properly documented moisture reading can help prove that the loss was active, measurable, and real at the time of inspection. It can show that water affected specific materials in specific rooms, walls, ceilings, floors, cabinets, baseboards, or building components. It can help explain why mitigation was necessary, why demolition was reasonable, why drying equipment was used, and why certain repairs were included in the estimate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It also helps later experts.</span></p><p style="text-align:justify;"><span style="font-size:18px;">An engineer or consultant retained months later may not be able to recreate the original moisture condition. By then, the property may have dried or changed. But if the original inspection included organized moisture readings, photographs of the meter in use, location notes, room labels, diagrams, thermal images, and a moisture map, the later expert has a factual record to rely on. The expert can explain that even though the moisture condition no longer exists in the same form, it was documented when it mattered.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That matters because the defense will often point to the present condition and pretend it proves the past condition.</span></p><p style="text-align:justify;"><span style="font-size:18px;">They may say, “We did not observe elevated moisture.”</span></p><p style="text-align:justify;"><span style="font-size:18px;">But the answer is: of course you did not. You inspected after the drying. After the demolition. After the repair. After the materials changed. After the evidence started disappearing.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Moisture documentation captures the loss before it disappears.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That makes it powerful in litigation. It helps rebut the argument that damage was speculative or exaggerated. It helps explain why a contractor acted when they did. It helps connect the repair scope to measured conditions, not just subjective observation. It helps show that the work was not invented after the dispute began.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A moisture meter reading also helps tell the story to a jury. Jurors understand water. They understand that wet materials can dry. They understand that something can be real even if it is not visible months later. When the lawyer can show them the photograph, the meter reading, the location, the room, the thermal image, and the repair that followed, the sequence becomes easier to believe.</span></p><p style="text-align:justify;"><span style="font-size:18px;">This is the chain:</span></p><ul><li><span style="font-size:18px;">The loss occurred.</span></li><li><span style="font-size:18px;">The area was inspected.</span></li><li><span style="font-size:18px;">The thermal image showed an area of concern.</span></li><li><span style="font-size:18px;">The moisture meter confirmed elevated readings.</span></li><li><span style="font-size:18px;">The readings were documented by location.</span></li><li><span style="font-size:18px;">The materials were dried, removed, or repaired.</span></li><li><span style="font-size:18px;">The estimate was built from that documented condition.</span></li><li><span style="font-size:18px;">The later expert relied on that preserved record.</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">That is how a moisture reading becomes more than a number. It becomes a bridge between the condition at the time of loss and the repair scope later disputed in litigation.</span></p><p style="text-align:justify;"><span style="font-size:18px;">But the documentation has to be done correctly.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Do not simply write “wet wall” in a note. Photograph the meter. Identify the room. Identify the material. Mark the location. Use consistent naming. Pair the reading with ordinary photos and thermal images when available. Create a moisture map if the loss is significant. Take baseline readings, if possible, of dry or normal materials. Record the date, time, and inspection conditions. Preserve the data in a way that the expert, lawyer, mediator, or jury can understand months or years later.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The goal is not just to prove that water existed, the goal is to preserve the reasonableness of the response.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Why was mitigation performed? Why was drywall removed? Why were cabinets detached? Why was flooring replaced? Why did the estimate include that room, that wall, that baseboard, that ceiling, or that material? Moisture readings help answer those questions.</span></p><p style="text-align:justify;"><span style="font-size:18px;">In property claims, some of the most important evidence disappears because the very purpose of mitigation is to make it disappear. Drying is supposed to work. Repairs are supposed to restore the property. But if the evidence is not captured before that happens, the defense may later use the success of mitigation as an argument that the damage was never serious.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is backwards.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Good moisture documentation prevents that argument. It proves the condition before it changed. It helps later experts justify the repair. It gives the lawyer a record to defend the scope. And it helps the jury understand why the work was necessary even if the property looks different by the time the case is tried.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Moisture meter readings do not replace expert judgment. They give expert judgment a factual foundation, and most importantly, they preserve the disappearing evidence.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Conclusion</span></h2><p style="text-align:justify;"><span style="font-size:18px;">By the time a property case reaches my desk, the fight has usually already started.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The carrier has questioned the damage. The scope has been cut. The estimate has been minimized. Someone has decided the loss is not what the insured, the contractor, the adjuster, or the expert says it is. And by then, the most important evidence may already be changing.</span></p><ul><li><span style="font-size:18px;">The water has dried.</span></li><li><span style="font-size:18px;">The drywall has been removed.</span></li><li><span style="font-size:18px;">The roof has been tarped, patched, or replaced.</span></li><li><span style="font-size:18px;">The flooring has been pulled.</span></li><li><span style="font-size:18px;">The room has been painted.</span></li><li><span style="font-size:18px;">The smell is gone.</span></li><li><span style="font-size:18px;">The homeowner has moved back in, moved out, or sold the house.</span></li><li><span style="font-size:18px;">The scene that mattered most may no longer exist.</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">That is the problem modern documentation has to solve.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It is not enough to show up later with opinions. It is not enough to hand a lawyer a stack of photographs and an estimate and expect it to become leverage. It is not enough to say, “Trust me, the damage was there.” Litigation does not work on trust. Insurance companies do not pay serious money on trust. Opposing counsel does not recommend settlement because somebody sounds confident.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The proof has to be captured when the proof still exists.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That means the inspection is not just an inspection. It is the beginning of the case. Every photograph, every 360-degree walkthrough, every video, every roof model, every floor plan, every moisture reading, every thermal image, every timestamp, every annotation, every measurement, and every report becomes part of the record that will either make the case easier to prove or easier to attack.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is why the standard has changed.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Modern documentation tools are no longer optional in serious claims work. They are not toys. They are not marketing materials. They are not something to use only when the job is large or the client is sophisticated. They are how we preserve reality before reality changes.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A 360-degree walkthrough lets the lawyer, expert, mediator, opposing counsel, and jury walk the property long after the property has changed. A video captures the movement, sound, condition, and human context that still photographs miss. A roof model gives the estimate a measurement backbone. A floor plan gives the damage a location. A photo timeline gives the case sequence. Thermal imagery helps reveal what ordinary photographs cannot show. Moisture meter readings preserve evidence that is literally disappearing by design.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Drying is supposed to work. It gives opposing counsel something real to report to the carrier. And if the case reaches trial, it gives the jury a way to see what happened instead of merely hearing people argue about it.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The right tool still depends on the job. Hover, Docusketch, Matterport, CompanyCam, MagicPlan, thermal cameras, moisture meters, videos, ordinary photographs, and written reports all serve different purposes. No single tool proves every issue. No single platform wins every category. But together, used correctly, they can turn a disputed claim into a documented record.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is what I need.</span></p><p style="text-align:justify;"><span style="font-size:18px;">If you want to help policyholders end up with stronger cases, then help build proof. Scattered photographs, vague measurements, unsupported estimates, and opinions with no visual foundation do not get the job done. No lawyer can fully explain a loss that was never properly preserved. And no expert should be expected to reconstruct a property months later from a handful of photos taken from unknown angles.</span></p><p style="text-align:justify;"><span style="font-size:18px;">If you are not using 360-degree walkthrough technology, video documentation, organized photo systems, measurements, thermal imagery when appropriate, moisture readings when appropriate, and defensible reporting, then you are not helping build the kind of case that holds up when it is taken into battle.</span></p><p style="text-align:justify;"><span style="font-size:18px;">And when that documentation is missing, the case is harder to prove for everyone involved, starting with the policyholder.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That may sound harsh, but it is not personal. It is practical.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The other side is going to attack the claim. They are going to challenge causation. They are going to challenge scope. They are going to challenge price. They are going to challenge the expert. They are going to look for missing photographs, missing measurements, missing readings, missing context, and missing proof.</span></p><p style="text-align:justify;"><span style="font-size:18px;">So do not give them the opening.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Build the record before the denial is written. Preserve the evidence before it disappears. Give the expert the data before the property changes. Give the lawyer the visuals before mediation. Give the jury the story before the defense turns the case into confusion.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Because by the time the lawsuit is filed, it may already be too late to document the case the way it should have been documented in the beginning.</span></p><p style="text-align:justify;"><span style="font-size:18px;">You want faster settlements? Better evidence comes from better documentation. </div><div data-element-id="elm_IFZa9aQWbDUUu85UAuKcBA" data-element-type="text" class="zpelement zpelem-text "><style></style><div class="zptext zptext-align-left zptext-align-mobile-left zptext-align-tablet-left " data-editor="true"><p style="text-align:justify;"><span style="font-size:18px;">In a property damage claim, an estimate is not supposed to be a negotiation anchor. It is supposed to be evidence. That distinction matters. When a covered roof replacement is required, the reasonable cost of repair is not limited to the visible shingle field. A proper roof estimate must account for the work, materials, labor, disposal, and job conditions reasonably necessary to do the repair in the real world. That includes roof waste. It also includes removing, loading, hauling, and disposing of the damaged roofing materials.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Those items are not &quot;extras&quot; just because they increase the estimate. If they are reasonably necessary to complete the covered repair, they belong in the estimate. The issue is not whether a carrier, contractor, public adjuster, or appraiser prefers a lower number. The issue is whether the estimate reflects the reasonable cost of the necessary repair, and whether the file contains evidence supporting that scope. (A note up front: I am not an Xactimate trainer, and this article is general commentary on estimating and evidence, not software training.)</span></p><h2 style="text-align:left;"><span style="font-size:26px;">The claimant's burden is proof, not magic words</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Texas case law on repair costs provides a useful framework for evaluating estimating disputes. In an insurance claim, the policy language controls what the carrier owes, but the evidence questions are much the same: what repair is needed, and what does it reasonably cost?</span></p><p style="text-align:justify;"><span style="font-size:18px;">The Texas Supreme Court has said that &quot;[a] party seeking to recover remedial damages must prove that the damages sought are reasonable and necessary.&quot; <em>McGinty v. Hennen</em>, 372 S.W.3d 625, 627 (Tex. 2012) (per curiam).</span></p><p style="text-align:justify;"><span style="font-size:18px;">But Texas law does not require a claimant to recite the words &quot;reasonable&quot; and &quot;necessary&quot; like a formal incantation. In <em>Hernandez v. Lautensack</em>, a roofing case, the Fort Worth Court of Appeals explained that &quot;it is not necessary for a claimant to use the words 'reasonable' and 'necessary'; a claimant need only present sufficient evidence to justify a jury's finding that the costs were reasonable and the repairs necessary.&quot; <em>Hernandez v. Lautensack</em>, 201 S.W.3d 771, 776-77 (Tex. App.—Fort Worth 2006, pet. denied) (citing <em>Ebby Halliday Real Estate, Inc. v. Murnan</em>, 916 S.W.2d 585, 589 (Tex. App.—Fort Worth 1996, writ denied); <em>Ron Craft Chevrolet, Inc. v. Davis</em>, 836 S.W.2d 672, 677 (Tex. App.—El Paso 1992, writ denied)).</span></p><p style="text-align:justify;"><span style="font-size:18px;">That rule matters in roof estimating disputes. The question is not whether an estimate has the phrase &quot;reasonable and necessary&quot; next to every line item. The question is whether the estimate, testimony, photographs, measurements, pricing support, and job conditions give a sufficient evidentiary basis to conclude that the work is needed and the cost is reasonable.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">What Texas courts say about repair estimates as evidence</span></h2><p style="text-align:justify;"><span style="font-size:18px;">The Texas Supreme Court addressed repair estimates in <em>Bennett v. McDaniel</em>, 295 S.W.3d 644 (Tex. 2009) (per curiam), a roof-repair case. The Court disagreed with the court of appeals' statement that an estimate, without the testimony of the person who prepared it or other expert testimony, is no evidence. The Court noted that such an estimate might ordinarily be excluded as hearsay, but no hearsay objection was made. Even so, the Court held the damages evidence legally insufficient because the homeowner merely stated an estimated price and did not testify that the estimate was reasonable. The Court sent the case back for a new trial.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That distinction is important. <em>Bennett</em> does not mean any number labeled &quot;estimate&quot; automatically proves damages. It stands for a more practical point: an estimate is not categorically worthless just because the estimator does not testify, but someone still has to connect it to reasonableness. And be ready for a hearsay objection.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Other Texas courts have applied similar reasoning. In <em>Bernstein v. Thomas</em>, a foundation-repair case, the Dallas Court of Appeals said that &quot;[a]n objective valuation of services, such as a bill, receipt or, as in this case, an estimate, is evidence from which a jury can infer reasonable cost of repair.&quot; <em>Bernstein v. Thomas</em>, 298 S.W.3d 817 (Tex. App.—Dallas 2009). In <em>Seasha Pools, Inc. v. Hardister</em>, 391 S.W.3d 635 (Tex. App.—Austin 2012, no pet.), the Austin Court of Appeals recognized that a repair estimate, such as a bid, is some evidence of repair cost, and that property owners may testify about repair costs based on estimates they obtain from third parties. (In that case, the pool builder had stipulated that the bids were reasonable.)</span></p><p style="text-align:justify;"><span style="font-size:18px;">The other side of the coin matters just as much for this article. In <em>McGinty</em>, the homeowner's witness derived his repair costs from an &quot;Exactimate&quot; program &quot;that's used widely in the insurance industry.&quot; The Texas Supreme Court held that this was not enough on its own to prove the costs were reasonable, and it rendered judgment against the homeowner on that claim. <em>McGinty</em>, 372 S.W.3d at 627-28. In other words, a number coming out of estimating software is not self-proving, whether it is the carrier's number or the policyholder's.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The practical rule is straightforward: a repair estimate is not just a number. Properly supported, it is evidence. Unsupported, it may not be enough.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Roof waste is a function of the repair, not a windfall</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Roof waste is often disputed because it is easy to mischaracterize. It is sometimes called &quot;padding,&quot; &quot;profit,&quot; or &quot;contractor fluff.&quot; Those descriptions are inaccurate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Waste is a material requirement created by installation. Shingles are not installed by digitally stretching them across the measured roof surface. They are cut, lapped, offset, started, capped, and fitted around roof geometry. Hips, valleys, rakes, ridges, dormers, penetrations, transitions, and roof-to-wall conditions all affect how much material is reasonably required to complete the installation.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A simple two-plane gable roof and a cut-up hip roof do not present the same waste issue. A low-slope roof and a steep, complex roof do not present the same installation conditions. A roof with multiple valleys, dormers, ridge changes, and intersecting planes will generally require more cutting and fitting than a simple roof. Those differences matter.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A roof estimate that calculates only the surface area and then refuses to account for installation waste is not conservative. It is incomplete. The proper sequence is measurement first, waste second. IKO's guide <a href="https://www.iko.com/na/wp-content/uploads/sites/8/document-library/Estimating-How-Much-Roofing-Is-Required.pdf" target="_blank" rel="noopener">Estimating How Much Roofing Is Required</a> explains that roofs can be broken into simple geometric shapes, that projected horizontal area is converted to actual roof area using a factor based on roof slope, and that an allowance for waste is then added. In the guide's worked example, the actual roof area is 2,347 square feet, and a 10% waste allowance (235 square feet) brings the material requirement to 2,582 square feet.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That example illustrates the correct order. Waste is not a substitute for measurement. Measurement is not a substitute for waste. Both are part of a complete roof material calculation.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">The right waste factor depends on the roof</span></h2><p style="text-align:justify;"><span style="font-size:18px;">No serious estimator should claim that every roof requires the same waste factor. And no serious estimator should claim that a roof requires no waste at all. The proper inquiry is roof-specific. The relevant considerations include the number of roof planes, pitch, hips, valleys, dormers, roof-to-wall transitions, penetrations, rake conditions, starter and ridge requirements, shingle type, installation method, layout restrictions, and whether specialty, laminated, or designer shingles are being installed.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Industry guidance is consistent with that approach. Roofr <a href="https://roofr.com/blog/how-to-calculate-roof-waste-factor" target="_blank" rel="noopener">defines the roof waste factor</a> as the extra material needed to account for cuts, overlaps, and mistakes during installation, and lists roof complexity (valleys, hips, dormers), material type, slope, installer experience, and weather as factors that affect waste. Roofr describes roughly 10% to 15% as a common starting estimate, and says the figure goes up or down depending on those factors. Treat numbers like that for what they are: industry rules of thumb, not a published standard or a rule of law.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is why a flat percentage applied without explanation is vulnerable. But deleting waste without explanation is equally vulnerable.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The most defensible estimate states its assumptions. If an estimate applies 10%, 12%, 15%, or another waste factor, the file should explain why that factor fits that roof. A clean roof diagram, pitch documentation, photographs, material selection, and notes on hips, valleys, dormers, and layout conditions can turn a disputed waste item into a supported part of the repair estimate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The same principle cuts both ways. A contractor should not add a high waste percentage just to get more money. An insurer should not delete waste just to get a lower estimate. Both positions miss the point. The question is evidentiary: what waste factor is reasonable for this roof, under these conditions, and what evidence supports it?</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Disposal is a separate cost created by tear-off</span></h2><p style="text-align:justify;"><span style="font-size:18px;">The same analysis applies to dump fees. When an estimate pays to remove damaged shingles, the debris does not disappear at the roof edge. It must be removed from the property. That can involve labor, loading, a dump trailer, a roll-off container, a landfill or transfer station, weight limits, local disposal charges, minimum fees, and possibly multiple trips.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Disposal is not theoretical. It is a required consequence of tear-off. The number of layers matters. The type of shingle matters. The weight of the debris matters. Local landfill pricing matters. Access matters. Whether a contractor can place a dumpster on site matters. Whether debris must be hand-carried to a trailer matters. Whether the load exceeds the included tonnage matters.</span></p><p style="text-align:justify;"><span style="font-size:18px;">An estimate that includes roof tear-off but leaves out the reasonable cost of disposing of the torn-off material is missing part of the repair cost.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Weight is a big part of this. GAF <a href="https://www.gaf.com/en-us/blog/residential-roofing/choosing-the-right-sized-roofing-dumpster-for-your-next-project-0864a7d8-6044-4834-b1f1-25231ef866c0" target="_blank" rel="noopener">notes</a> that choosing the right dumpster size helps avoid unwanted delays and that exceeding a dumpster's weight limit can result in hefty fees. IKO likewise <a href="https://www.iko.com/na/blog/dumpster-size-for-roofing/" target="_blank" rel="noopener">explains</a> that dumpster sizing for roofing is not just about roof size; it also depends on the type and weight of the shingle debris and the rental company's weight limit. IKO adds that asphalt shingles are among the heavier materials dumpster companies accept and that, generally, you can't fill a dumpster to the brim with asphalt shingles without exceeding the weight limit.</span></p><p style="text-align:justify;"><span style="font-size:18px;">For that reason, a proper roof estimate should tie the disposal charge to the actual job conditions. It should not just insert a generic dump fee. And it should not delete the fee by assuming disposal is free.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Local disposal pricing is evidence</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Dump fees are local costs. A disposal rate in Travis County is not necessarily the same as one in Dallas, Houston, San Antonio, or El Paso. The estimate should account for where the work is performed and the facility, hauler, or vendor that will receive the debris.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Where available, the estimate should be supported by published landfill rates, vendor invoices, dumpster quotes, receipts, or contractor pricing tied to the actual job. That kind of support moves the dispute from opinion to proof.</span></p><p style="text-align:justify;"><span style="font-size:18px;">For example, Waste Connections publishes gate-rate information for the <a href="https://www.wasteconnections.com/travis-county-landfill" target="_blank" rel="noopener">Travis County Landfill</a> near Austin. When I checked that page, it listed a per-ton gate rate for construction-and-demolition debris, a two-ton minimum load charge, and add-on fees for items such as hard-to-handle loads, dig-outs, and reloads. Rates change, so pull the current schedule for the facility your job will actually use.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That kind of local pricing is relevant because disposal charges are not abstract. They are actual project costs incurred at actual facilities under actual pricing schedules. The same is true of minimum charges. Many facilities do not charge only by the pound. Depending on the facility, pricing may involve minimum load charges, vehicle-based rates, volume-based rates, material-specific rates, tonnage rates, or other facility-specific charges. A small roof can still trigger a minimum disposal charge. A large roof can trigger overweight fees or require a larger container.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The proper question is not whether an adjuster personally thinks the dump fee &quot;seems high.&quot; The proper question is whether the amount is supported by the disposal method, the debris generated, the project location, and the pricing available for that job.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Don't mix shingle waste with other debris without accounting for pricing differences</span></h2><p style="text-align:justify;"><span style="font-size:18px;">There is another reason to evaluate dump fees carefully: not all construction debris is priced or handled the same way. A roofing tear-off may generate asphalt shingles, underlayment, nails, drip edge, flashing, vents, ridge materials, rotten decking, fascia, soffit, drywall from interior access, insulation, pressure-treated wood, or other construction debris. Depending on the facility, those materials may not carry the same disposal rate, may not be accepted in the same way, and may not fall under the same pricing category.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That matters because a shingle disposal charge is not necessarily interchangeable with a mixed construction-and-demolition charge. Some facilities or recyclers may price or handle asphalt shingles differently from mixed construction debris. Pressure-treated wood may raise different disposal considerations than ordinary lumber. Drywall may be subject to different handling, recycling, contamination, or landfill rules depending on the facility.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A load that qualifies for one rate can become a different load, at a different price, if it is mixed with other materials. This is not an academic issue. The Travis County Landfill page, for example, lists the categories of material it accepts, including construction debris, concrete and asphalt, yard waste, clean fill, contaminated soil, and treated lumber. The receiving facility's acceptance rules and pricing categories are material to the estimate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The estimating consequence is simple: the estimate should identify the debris stream. If the roof scope involves asphalt shingle tear-off only, the disposal analysis may focus on the shingle debris, the number of layers, the estimated weight, the container size, the landfill or transfer station, and the applicable rate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">But if the repair also includes rotten decking, pressure-treated wood, drywall, insulation, fascia, soffit, siding, or other materials, the estimator must consider whether those materials change the disposal method or pricing category, and whether a separate container is needed.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That may require separating the debris streams. It may require separate line items. It may require a mixed construction-and-demolition rate instead of a shingle-specific rate. It may require a larger container, multiple containers, multiple trips, or different facility charges. It may also affect whether the load is accepted at all under the intended pricing category.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The point is not that every job needs multiple dumpsters. The point is that the estimate should not hide the issue. A defensible estimate should identify what is being disposed of, where, and whether the debris is being priced as shingles, mixed construction-and-demolition debris, special waste, or another category. Where materials are mixed, the estimate should explain why the selected disposal rate applies. Where materials must be separated, the estimate should account for the labor, container, hauling, and facility charges required.</span></p><p style="text-align:justify;"><span style="font-size:18px;">This is especially important in insurance estimating because roof claims often expand beyond shingles. A roof replacement may involve damaged decking. A storm claim may involve interior drywall repairs. A water intrusion claim may involve framing, sheathing, treated lumber, insulation, and gypsum products. Lumping those materials into one generic &quot;dump fee&quot; may understate or overstate the actual cost, depending on the facility's pricing rules.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The better practice is to treat disposal as a scoped item, not a miscellaneous charge. The estimator should ask:</span></p><ul><li><span style="font-size:18px;">What materials are being removed?</span></li><li><span style="font-size:18px;">Are shingles being disposed of separately?</span></li><li><span style="font-size:18px;">Is the load mixed with other construction debris?</span></li><li><span style="font-size:18px;">Does the facility price shingles differently from mixed construction-and-demolition debris?</span></li><li><span style="font-size:18px;">Does pressure-treated wood or drywall affect the disposal category?</span></li><li><span style="font-size:18px;">Do minimum charges or contamination charges apply?</span></li><li><span style="font-size:18px;">Does the selected Xactimate line item match the actual disposal condition?</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">If the debris stream changes, the price may change. That is why shingle waste should not be casually mixed with pressure-treated wood, drywall, or other construction debris and then priced as though all waste is the same. In a disputed estimate, saying &quot;debris disposal is included&quot; is not enough. The question is whether the disposal cost is supported by the actual debris generated, the facility that will receive it, and the pricing category that applies to that material.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Roofers are the roofing experts, and Xactimate is not their license</span></h2><p style="text-align:justify;"><span style="font-size:18px;">This raises a practical question: if roofers are the professionals who actually build roofs, why do they spend so much time arguing as though the carrier's Xactimate estimate is the default truth?</span></p><p style="text-align:justify;"><span style="font-size:18px;">A roofer is not hired because he knows how to click line items in Xactimate. A roofer is hired because he knows how to build a roof. Roofers know whether a roof can be repaired or must be replaced. They know how shingles are installed, how valleys are cut, when starter is required, and how ridge cap is installed. They know when decking is rotten, whether a tear-off is one layer or several, whether the driveway can take a dumpster, whether debris has to be hand-carried, and whether the tear-off is shingle-only or mixed debris. They know whether the job can actually be completed for the amount written on the carrier's estimate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That does not mean every roofer's estimate is automatically reasonable. It does mean the roofer should not let the dispute be framed as though roofing expertise is subordinate to the carrier's estimating software.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A roofer does not have to justify his price solely by forcing it through Xactimate. Texas courts ask whether there is evidence of the reasonable cost of necessary repairs. <em>See McGinty</em>, 372 S.W.3d at 627-28; <em>Hernandez</em>, 201 S.W.3d at 776-77; <em>Bennett</em>, 295 S.W.3d 644; <em>Bernstein</em>, 298 S.W.3d 817; <em>Seasha Pools</em>, 391 S.W.3d 635. That evidence may include an estimate, bid, invoice, supplier quote, labor scope, measurement report, photographs, job-site conditions, landfill rates, contractor testimony, and owner testimony about the estimate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Xactimate can be part of that proof. It is not the only way to prove it, and as <em>McGinty</em> shows, it is not proof by itself. A roofer's price may be supported by market pricing, supplier invoices, subcontractor quotes, labor availability, crew requirements, access conditions, disposal charges, landfill rates, warranty requirements, manufacturer specifications, building-code requirements, and the roofer's own cost structure. If that evidence supports the price, the fact that a carrier's Xactimate estimate produces a lower number does not end the analysis.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The question is not whether the roofer can make his estimate match the carrier's preferred Xactimate output. The question is whether the claimed amount represents the reasonable cost of the necessary repair. That changes the posture of the dispute.</span></p><p style="text-align:justify;"><span style="font-size:18px;">If a roofer claims 15% waste, he should be ready to explain why that roof requires it. If the roofer charges a separate dump fee, he should be ready to explain the debris stream, disposal method, facility pricing, container size, weight limits, and whether the load is shingle-only or mixed. If the roofer's price is higher than the carrier's Xactimate estimate, he should be ready to explain the scope, material cost, labor market, access, schedule, supervision, overhead, profit, risk, warranty, and job conditions.</span></p><p style="text-align:justify;"><span style="font-size:18px;">But that is proof, not permission. The roofer is not asking the carrier for permission to know roofing. The roofer is presenting evidence of what the roof requires and what it reasonably costs to do the work.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Roofers should stop arguing from the premise that the carrier's estimate is presumptively correct simply because it was written in Xactimate. Verisk <a href="https://www.verisk.com/products/xactimate/" target="_blank" rel="noopener">markets Xactimate</a> as property claims estimating software, with regional pricing data. It is a tool. It is not the Texas Pattern Jury Charge. It is not Chapter 542A of the Texas Insurance Code. It is not a substitute for a roofer's training and experience, or for a competent roofer's supported estimate.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The better approach is to present the roofing scope as roofing evidence: This is the roof. This is the damage. This is the required repair. This is the material. This is the waste. This is the tear-off. This is the debris. This is the disposal method. This is the price. This is why it is reasonable. That is how a roofing expert should frame the dispute. The roofer's job is not to reverse-engineer the carrier's number. The roofer's job is to state and support the cost to do the work correctly.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">A practical checklist for roof waste</span></h2><p style="text-align:justify;"><span style="font-size:18px;">In a disputed roof estimate, waste should be evaluated through evidence, not habit. A proper file should address:</span></p><ul><li><span style="font-size:18px;">Measured roof area and pitch-adjusted roof area.</span></li><li><span style="font-size:18px;">A roof diagram or measurement report.</span></li><li><span style="font-size:18px;">Roof complexity, including the number of hips, valleys, rakes, and ridges.</span></li><li><span style="font-size:18px;">Shingle type and installation method.</span></li><li><span style="font-size:18px;">Starter and ridge material.</span></li><li><span style="font-size:18px;">The selected waste factor, and the reason it fits this roof.</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">If the estimate has a waste factor but no explanation, it may need better support. If it has no waste factor at all, it may need a better scope. The question should not be whether waste can be removed from the estimate. It should be whether the claimed waste is reasonably necessary for the roof being installed.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">A practical checklist for dump fees</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Disposal should be evaluated the same way. A proper file should address:</span></p><ul><li><span style="font-size:18px;">The number of layers being removed and the type of roofing material.</span></li><li><span style="font-size:18px;">Approximate debris weight.</span></li><li><span style="font-size:18px;">The method of debris removal, and whether a dumpster or dump trailer is required.</span></li><li><span style="font-size:18px;">Container size, included weight limit, and the possibility of overweight charges.</span></li><li><span style="font-size:18px;">The landfill, transfer station, or disposal vendor, and its local rate and minimum charge.</span></li><li><span style="font-size:18px;">A quote, invoice, or receipt supporting the amount.</span></li><li><span style="font-size:18px;">Whether the debris is being disposed of as shingles, mixed construction-and-demolition debris, or another category.</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">A line item for tear-off does not necessarily mean disposal has been fully accounted for. If the torn-off material has to be hauled and dumped, that cost must be addressed somewhere in the estimate. And if the debris includes more than shingles, the disposal analysis must account for that.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A shingle-only disposal charge may not fit a mixed load. A mixed-load charge may not fit a shingle-only tear-off. A generic debris charge may not be adequate where the facility prices shingles, construction-and-demolition debris, pressure-treated wood, drywall, or special waste differently. Disposal is not just a quantity issue. It is a material-classification issue.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">The issue is not &quot;more money.&quot; The issue is proof.</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Roof waste and dump fees should not be added casually. They should be supported. But they also should not be deleted casually. They should be evaluated. That is the difference between adjusting a claim and cutting numbers.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Under Texas case law, the party seeking repair costs must present evidence from which a factfinder can determine the reasonable cost of necessary repairs. <em>McGinty</em>, 372 S.W.3d at 627; <em>Hernandez</em>, 201 S.W.3d at 776-77. A properly supported repair estimate can be part of that proof. <em>See Bennett</em>, 295 S.W.3d 644; <em>Bernstein</em>, 298 S.W.3d 817; <em>Seasha Pools</em>, 391 S.W.3d 635.</span></p><p style="text-align:justify;"><span style="font-size:18px;">For roofing claims, that proof should include the material reasonably required to install the roof and the cost reasonably required to dispose of the torn-off materials. It should also account for whether the debris is shingle-only or mixed construction debris subject to different pricing.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The better estimating question is not: &quot;Can we remove waste and dump fees?&quot;</span></p><p style="text-align:justify;"><span style="font-size:18px;">The better question is: &quot;What waste and disposal costs are reasonably necessary for this roof, at this property, under these job conditions, and what evidence supports them?&quot; That question is harder to answer. Too often, the inspection doesn't do its job.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Before I practiced law, I used ASTM E2018 to help build inspection protocols for my consulting and public adjusting work. I wanted to capture the complete picture. Not just the damage somebody reported. Not just the roof. Not just the easy stuff. The complete picture. This article explains what ASTM E2018 is, what it is not, and why its approach matters for Texas property damage claims.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Carriers usually inspect only what was reported</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Carriers almost always inspect what was reported. If the claim is reported as hail damage to a roof, the inspection usually focuses on hail damage to the roof. That may be fine for a narrow claim review, but it is not a full property damage investigation. That is where policyholder advocates and experts come in.</span></p><p style="text-align:justify;"><span style="font-size:18px;">A thorough investigation may find there was no hail damage. But it may also find wind damage. Or a separate water or mold issue. Or window damage. Or damage to elevations, fencing, detached structures, interior finishes, or other areas nobody identified when the claim was first reported. A thorough investigation protects the policyholder. It also protects the carrier when future claims are made for the same damage, or when someone says the damage was a pre-existing condition.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">The decision to make a claim belongs to the policyholder</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Carriers and defense attorneys may complain about policyholders making multiple claims. They may raise barratry arguments. They may say the claim has somehow grown beyond what was originally reported. They may blame policyholder advocates for driving claims. But the decision belongs to the policyholder.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The advocate's job is to uncover the evidence, present it to the policyholder, explain the options, give advice, and let the policyholder make an informed decision. That is why, in my view, the arguments blaming advocates miss the mark. An advocate cannot file a claim the client never agreed to. In my view, much of the blame placed on policyholders and their representatives is driven by the carrier's own financial interests.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Here is a simple example. Suppose I report a water loss and write a $100,000 estimate, and it turns out there was never a water leak. How would that claim ever get paid? The carrier won't pay it. A jury is unlikely to award it. Pursuing a claim is not free, so how would anyone make money bringing unsupported claims against an insurance carrier? An inflated estimate does not get paid without evidence to support it.</span></p><p style="text-align:justify;"><span style="font-size:18px;">In my time in Texas, I have seen adjusting and consulting become more about profit margins and less about getting it right. I have seen public adjusters turn down complex claims that appeared to be covered because they were hard. I have seen &quot;horse trading&quot; in appraisal over repair costs that I rarely saw seriously debated before. And I have seen carriers use aggressive tactics that discourage policyholders from pursuing claims, including pursuing disputed coinsurance penalties that, in my view, rested on a misapplied valuation tool.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Some inspections are thorough. Some are not.</span></h2><p style="text-align:justify;"><span style="font-size:18px;">In insurance claims, the outcome often depends on what an adjuster, engineer, consultant, contractor, or expert says they observed at the property. When you review reports, claim files, photographs, and deposition testimony, a pattern appears. Some inspections are thorough. Some are not.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Some include interviews, document review, prior repair history, weather data, photographs, measurements, and a clear explanation of what was and was not inspected. Others are little more than a short site visit, a handful of photographs, and a short-sighted conclusion.</span></p><p style="text-align:justify;"><span style="font-size:18px;">And if you can show me a file where a carrier's engineer found a separate covered cause of loss and the carrier then helped the policyholder file that separate claim, I would genuinely like to see it.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">A lesson from my consulting days: the checklist that missed a broken window</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Earlier in my career, before I practiced law, I worked as a consultant on a condominium storm claim where the other side's building-envelope consultants inspected the windows and doors. One window had been broken when a tree limb struck the glass during the storm, and the owner had boarded it up. To me, that was not complicated: the storm drove a tree limb into the window and broke the glass. But I could not get the other side to acknowledge it as storm damage.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Why? Because their inspection protocol was so narrow that it missed the forest for the trees. They were looking for a predetermined set of conditions, such as:</span></p><ol><li><span style="font-size:18px;">Sealant issues.</span></li><li><span style="font-size:18px;">Permanent deformation at the midspan of lock stiles.</span></li><li><span style="font-size:18px;">Permanent deformation of swing door lock stiles.</span></li><li><span style="font-size:18px;">Loose anchors.</span></li><li><span style="font-size:18px;">Racked frames.</span></li><li><span style="font-size:18px;">Permanent set of window system mullions.</span></li><li><span style="font-size:18px;">Damaged glazing gaskets of sliding glass doors.</span></li><li><span style="font-size:18px;">Damaged pile gaskets at sliding glass door lock jambs.</span></li><li><span style="font-size:18px;">Permanent deformation at vent frame sill rails.</span></li><li><span style="font-size:18px;">Permanent deformation at vent meeting rails.</span></li><li><span style="font-size:18px;">Damaged or missing gaskets.</span></li><li><span style="font-size:18px;">Water-damaged interior finishes.</span></li><li><span style="font-size:18px;">Rusted steel panels.</span></li><li><span style="font-size:18px;">Broken balances.</span></li><li><span style="font-size:18px;">Missing glass stops.</span></li><li><span style="font-size:18px;">Damaged shutter hardware.</span></li><li><span style="font-size:18px;">Peeling paint on railings and frames.</span></li><li><span style="font-size:18px;">Loose railing posts.</span></li><li><span style="font-size:18px;">Broken glass.</span></li><li><span style="font-size:18px;">Permanent deformation and frame separation.</span></li><li><span style="font-size:18px;">Damaged locksets.</span></li></ol><p style="text-align:justify;"><span style="font-size:18px;">Somehow, a tree limb breaking a window during a storm did not fit neatly into those categories. That is the problem with inspections that are not truly investigative. They can become outcome-oriented. In my opinion, that is what happened there.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The conversation should have been about the truth. If an inspection protocol only tells you which boxes to check, you may miss the obvious. A thorough inspection should not be limited to a predetermined list of preferred conditions. It should ask what happened, what changed, what evidence exists, what caused the condition, and whether the observed damage is consistent with the reported event.</span></p><p style="text-align:justify;"><span style="font-size:18px;">It also doesn't hurt to include a category for unexplained anomalies that need more investigation. A window boarded up after a storm should not disappear from the analysis just because the inspector is more comfortable talking about gaskets, mullions, lock stiles, and frame deformation, using big words I did not learn in law school.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That experience reinforced something I already believed: a narrow inspection produces narrow opinions. When the methodology is too narrow, the conclusion may sound technical, but it is not necessarily reliable. That is not good enough when the result may decide whether a policyholder gets the money needed to repair a home or business.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">What ASTM E2018 is, and what it is not</span></h2><p style="text-align:justify;"><span style="font-size:18px;">This is where ASTM E2018 comes in. Its full title is <em>Standard Guide for Property Condition Assessments: Baseline Property Condition Assessment Process</em> (the current edition is E2018-24). It was not written as an insurance claim standard. It is a guide for conducting property condition assessments (PCAs) of the primary improvements at commercial real estate properties, typically for transactions. But the principles behind it are highly relevant to property damage inspections, because it sets out something the insurance industry badly needs: a disciplined, repeatable process for evaluating the physical condition of a property. (And a disciplined process is exactly what helps an expert's opinion survive a reliability challenge.)</span></p><p style="text-align:justify;"><span style="font-size:18px;">The most important lesson from ASTM E2018 is simple. An inspection is not just walking around a property and looking at the damage the insured told you about. A real property condition assessment is a process. Under the guide, it includes:</span></p><ul><li><span style="font-size:18px;">Document review.</span></li><li><span style="font-size:18px;">Interviews with people who know the property.</span></li><li><span style="font-size:18px;">A walk-through survey by a field observer.</span></li><li><span style="font-size:18px;">Research.</span></li><li><span style="font-size:18px;">Opinions of the probable cost to address the deficiencies found.</span></li><li><span style="font-size:18px;">A written property condition report that explains the observations, limitations, and opinions.</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">Those pieces matter because they create context. A roof does not exist in a vacuum. A wall stain does not explain itself. Stucco cracking, moisture damage, displaced shingles, failed sealant, interior staining, rot, microbial growth, or structural movement cannot be fairly evaluated without asking basic questions:</span></p><ul><li><span style="font-size:18px;">What was the condition before the loss?</span></li><li><span style="font-size:18px;">Were there prior repairs?</span></li><li><span style="font-size:18px;">Were there prior claims?</span></li><li><span style="font-size:18px;">Was maintenance performed?</span></li><li><span style="font-size:18px;">Did anyone observe the damage before the inspection?</span></li><li><span style="font-size:18px;">Are there photographs from before and after the storm?</span></li><li><span style="font-size:18px;">Were permits pulled?</span></li><li><span style="font-size:18px;">Were contractors involved?</span></li><li><span style="font-size:18px;">Were temporary repairs made?</span></li><li><span style="font-size:18px;">Was access limited?</span></li><li><span style="font-size:18px;">Was anything hidden, covered, removed, repaired, or altered before the inspection?</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">These questions are not technicalities. They are the foundation of a reliable inspection. When there are multiple explanations, apply Occam's razor: the explanation that relies on the fewest assumptions is usually the right one. In my experience, jurors tend to credit the most logical explanation over the most scientific-sounding one, because they apply their own knowledge and life experience to the facts.</span></p><p style="text-align:justify;"><span style="font-size:18px;">An engineer may end up on a jury, but more often jurors are everyday people with everyday experience. Having all the facts helps lead them to the truth.</span></p><p style="text-align:justify;"><span style="font-size:18px;">ASTM E2018 recognizes this. It treats the walk-through survey as only one part of the assessment. That is the part many people miss. The physical inspection is important, but it is not the entire investigation. The inspection should be informed by records, interviews, history, and the purpose of the assessment.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The same concept should apply to property damage claims. When an engineer or adjuster reaches a conclusion without reviewing available documents, without interviewing knowledgeable people, without considering prior condition, and without clearly explaining the limits of the inspection, the opinion may look official. But the methodology is weak.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Why it matters in Texas: <em>State Farm v. Simmons</em></span></h2><p style="text-align:justify;"><span style="font-size:18px;">The need for real inspection and investigation protocols is not just theoretical. Look at the Texas Supreme Court's decision in <em>State Farm Fire &amp; Casualty Co. v. Simmons</em>, 963 S.W.2d 42 (Tex. 1998).</span></p><p style="text-align:justify;"><span style="font-size:18px;">In that case, the insureds' home was destroyed by fire. State Farm tagged the claim as &quot;suspicious&quot; right away because of a relatively recent theft claim. State Farm later denied the fire claim and raised arson as a defense, but the jury found the insureds had not burned their home. The problem was not simply that State Farm reached the wrong conclusion. The problem was how it got there.</span></p><p style="text-align:justify;"><span style="font-size:18px;">The Texas Supreme Court held there was evidence that State Farm did not make a good-faith effort to objectively investigate the claim, and that it instead conducted an outcome-oriented investigation designed to place the insureds at the center of an &quot;arson triangle.&quot;</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is exactly why investigation protocols matter. The insureds had given State Farm the names of several people who may have had grudges against them. State Farm's own adjuster testified that revenge and spite are among the more common motives for arson, and the county fire marshal testified similarly. Yet there was evidence that State Farm never tried to locate or contact those potential suspects before denying the claim.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is the danger of a narrow investigation. If the goal is to support a denial, the inspection becomes a search for facts that fit the denial. If the goal is to find the truth, the investigation must include facts that may support coverage, facts that may defeat coverage, and facts that call for more investigation.</span></p><p style="text-align:justify;"><span style="font-size:18px;"><em>Simmons</em> is important because the Court said plainly that an insurer &quot;cannot insulate itself from bad faith liability by investigating a claim in a manner calculated to construct a pretextual basis for denial.&quot; <em>Id.</em> at 44.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That principle applies directly to property damage inspections. A protocol does not tell the inspector what conclusion to reach. It tells the inspector what must be considered before reaching one:</span></p><ul><li><span style="font-size:18px;">What was inspected?</span></li><li><span style="font-size:18px;">What was not inspected?</span></li><li><span style="font-size:18px;">Who was interviewed?</span></li><li><span style="font-size:18px;">What documents were reviewed?</span></li><li><span style="font-size:18px;">What alternative causes were considered?</span></li><li><span style="font-size:18px;">What facts supported coverage?</span></li><li><span style="font-size:18px;">What facts supported denial?</span></li><li><span style="font-size:18px;">What assumptions were made?</span></li><li><span style="font-size:18px;">What limitations existed?</span></li><li><span style="font-size:18px;">What was left unresolved?</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">Those questions separate an investigation from a conclusion-driven inspection. <em>Simmons</em> also shows why guides like ASTM E2018 are useful, even though E2018 was not written for insurance claims. It forces the professional to think in terms of process: document review, interviews, walk-through survey, observations, limitations, and reporting.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That kind of process was what the evidence showed was missing in <em>Simmons</em>. State Farm had leads that needed to be followed. It had potential witnesses who needed to be contacted. It had a theory, and the jury could find that the investigation was built around that theory instead of the facts. That is not a thorough investigation. That is a conclusion looking for support. A true search for the truth includes gathering all the evidence.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Sit down with the other side's expert</span></h2><p style="text-align:justify;"><span style="font-size:18px;">How often does the carrier's expert sit down with the policyholder's expert to understand why they reached different conclusions?</span></p><p style="text-align:justify;"><span style="font-size:18px;">I have done exactly that. Earlier in my career, as a consultant, I was retained as a cost expert on a claim where the defense also had a cost expert. The experts and the attorneys met at the house. There was no legal wrangling, no sequestration of witnesses, and no gamesmanship. The attorneys were there to get to the truth.</span></p><p style="text-align:justify;"><span style="font-size:18px;">We walked the property. We discussed the scope. We talked through the disputed items. We looked at the actual conditions instead of just arguing over reports. That meeting did more to narrow the dispute than any exchange of reports could have. I believe many claims could be resolved faster if more people did exactly this.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Weak methodology leads to weak conclusions</span></h2><p style="text-align:justify;"><span style="font-size:18px;">This is especially important in litigation. Courts do not simply look at an expert's title or years of experience. When a witness tells me, &quot;I have been doing this for 20 years,&quot; my follow-up question is often whether he has been doing it wrong the whole time.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Courts look at the method. In federal court, the framework comes from <em>Daubert v. Merrell Dow Pharmaceuticals, Inc.</em>, 509 U.S. 579, 593-95 (1993), and Federal Rule of Evidence 702. <em>Daubert</em> lists factors a judge may consider, including whether the theory or technique can be and has been tested, whether it has been subjected to peer review and publication, its known or potential error rate and the standards controlling its operation, and whether it is generally accepted in the relevant scientific community. The Court called the inquiry &quot;a flexible one,&quot; focused on principles and methodology rather than the conclusions they produce. The U.S. Supreme Court later applied this gatekeeping role to engineers and other non-scientific experts in <em>Kumho Tire Co. v. Carmichael</em>, 526 U.S. 137 (1999). Rule 702 was amended in 2023 to make clear that the proponent must show it is more likely than not that the expert's opinion reflects a reliable application of reliable methods to the facts.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Texas state courts apply a similar approach under Texas Rule of Evidence 702. In <em>E.I. du Pont de Nemours &amp; Co. v. Robinson</em>, 923 S.W.2d 549 (Tex. 1995), the Texas Supreme Court required that expert testimony be relevant and rest on a reliable foundation. In <em>Gammill v. Jack Williams Chevrolet, Inc.</em>, 972 S.W.2d 713, 726 (Tex. 1998), the Court made clear that the reliability requirement applies to all expert testimony, and that a court may conclude &quot;there is simply too great an analytical gap between the data and the opinion proffered.&quot;</span></p><p style="text-align:justify;"><span style="font-size:18px;">ASTM E2018 helps because it gives us a framework to talk about methodology. It does not answer every question in an insurance claim. It does not replace engineering standards. And by its own terms, a PCA is not intended to be technically exhaustive. But it does provide a baseline way of thinking:</span></p><ul><li><span style="font-size:18px;">What was reviewed?</span></li><li><span style="font-size:18px;">Who was interviewed?</span></li><li><span style="font-size:18px;">What was observed?</span></li><li><span style="font-size:18px;">What was not observed?</span></li><li><span style="font-size:18px;">What assumptions were made?</span></li><li><span style="font-size:18px;">What limitations existed?</span></li><li><span style="font-size:18px;">What conditions require further investigation?</span></li><li><span style="font-size:18px;">What information came from the inspector's own observations, and what came from others?</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">Those questions should be answered in every serious property damage inspection.</span></p><h2 style="text-align:left;"><span style="font-size:26px;">A good report admits its limitations</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Another important part of ASTM E2018 is its recognition of limitations. No inspection eliminates all uncertainty:</span></p><ul><li><span style="font-size:18px;">Some conditions are concealed.</span></li><li><span style="font-size:18px;">Some components are not accessible.</span></li><li><span style="font-size:18px;">Some systems require specialized testing.</span></li><li><span style="font-size:18px;">Some conclusions require further investigation.</span></li></ul><p style="text-align:justify;"><span style="font-size:18px;">A good report admits that. How often have you seen a carrier's report include a meaningful limitations section? I included one in every expert report I wrote. If the inspection was done after repairs were made, disclose it. If there were multiple claims, disclose it. If there were inaccessible areas, disclose it. If the attic was not inspected because it was too hot, too dangerous, or because the inspector was too busy, disclose it. Bad reports pretend uncertainty does not exist.</span></p><p style="text-align:justify;"><span style="font-size:18px;">In files I have reviewed over the years, I have seen an engineer acknowledge that five different wind events could have caused the damage, yet conclude that the one event claimed was not the cause. I have seen another engineer write that winds as high as claimed would have left evidence such as downed trees and debris, while his own photos showed a blown-over tree.</span></p><p style="text-align:justify;"><span style="font-size:18px;">In my opinion, that is one of the biggest differences between a reliable expert and an unreliable one. A reliable expert tells you what they know, what they observed, what they reviewed, what they could not determine, and what additional work may be needed. And they explain it in a way my kids could understand.</span></p><p style="text-align:justify;"><span style="font-size:18px;">An unreliable expert jumps straight to the conclusion. The first clue is often the language. For example: &quot;As part of our inspection, a floor elevation survey was performed using a digital fluid-column instrument.&quot; Just say what you did: &quot;I checked the elevation of the slab using a four-foot level.&quot;</span></p><h2 style="text-align:left;"><span style="font-size:26px;">Document what is not damaged, too</span></h2><p style="text-align:justify;"><span style="font-size:18px;">Property damage inspections need more discipline, more consistency, and better documentation. They need protocols that can be explained, defended, and repeated.</span></p><p style="text-align:justify;"><span style="font-size:18px;">ASTM E2018 is not the final answer for insurance claims, but it is a very useful starting point. It reminds us that property inspections should not be casual, outcome-driven, or improvised. They should follow a process that includes observation, documentation, interviews, document review, identification of limitations, and a clear written explanation of the basis for the opinion. It should also include documenting what is not damaged. That part is often overlooked.</span></p><p style="text-align:justify;"><span style="font-size:18px;">When I inspected a house for damage, I wanted every accessible window checked and photographed, inside and out. Not just the broken ones. Not just the ones the insured mentioned. Every accessible window.</span></p><p style="text-align:justify;"><span style="font-size:18px;">Why? Because window damage, seal failure, and related problems can show up days or weeks after an event. Documenting the apparent lack of damage can be just as important as documenting the damage itself. It creates a baseline. It helps the policyholder. It helps future experts. It helps separate one loss from another. It helps prove what changed. And it keeps the inspector from missing something, serving as a check against shortcuts and time pressure.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is what good inspection protocols do. They protect the truth. The insurance industry does not suffer from a shortage of opinions. It suffers from a shortage of reliable methodology. Until property damage inspections are treated as a true investigative discipline, we will keep seeing reports that say what happened without adequately explaining how the inspector got there.</span></p><p style="text-align:justify;"><span style="font-size:18px;">That is why ASTM E2018 matters. A city also may not require disclosure of that value or cost as a condition of the permit, except as required by FEMA for participation in the National Flood Insurance Program. The statute applies to residential dwellings; commercial fee schedules may still use valuation, so check the local rules.</span></p><p style="text-align:justify;"><span style="font-size:18px;"><strong>Cities face a decision deadline.</strong> Local Government Code § 214.904 generally requires a city to grant or deny a covered building permit within 45 days of the application (or give written notice explaining why it cannot, or agree to a different deadline). If the city then misses that extended or agreed deadline, the statute bars it from collecting permit fees and requires it to refund fees already collected. Review the statute’s conditions before relying on it.</span></p><p style="text-align:justify;"><span style="font-size:18px;"><strong>Residential code baseline.</strong> Local Government Code § 214.212 adopts the International Residential Code as the municipal residential building code, and cities may adopt local amendments and later editions. Knowing which edition and amendments a city has adopted matters when pricing code-required work.</span></p><p style="text-align:justify;"><span style="font-size:18px;"><strong>Limits on local product bans.</strong> Texas Government Code § 3000.002 generally prohibits a governmental entity from banning a building product, material, or method allowed by a national model code published within the last three code cycles, subject to listed exceptions, including standards tied to windstorm insurance eligibility.</span></p><p style="text-align:left;margin-top:24px;"><span style="font-size:22px;"><strong>Counties are different</strong></span></p><p style="text-align:justify;"><span style="font-size:18px;">Texas counties generally do not have broad authority to require building permits for homes in unincorporated areas. Under Local Government Code chapter 233, subchapter F, a qualifying county that opts in may require new single-family homes and duplexes to meet the International Residential Code and to be inspected by qualified private inspectors, but the county’s ability to charge fees for that program is limited. A rural project may therefore have no county building permit fee, yet still need floodplain, septic, or fire code approvals and private inspection costs.</span></p><p style="text-align:left;margin-top:24px;"><span style="font-size:22px;"><strong>Coastal projects: windstorm certification</strong></span></p><p style="text-align:justify;"><span style="font-size:18px;">For property in the Texas Windstorm Insurance Association’s designated catastrophe area, Texas Insurance Code § 2210.251 generally requires construction, alterations, and repairs, including re-roofs, to comply with the applicable building standards for the structure to be insurable through TWIA. The Texas Department of Insurance issues the Certificate of Compliance (Form WPI-8-E) for completed work. Engineering and inspection costs to obtain that certificate belong in coastal estimates.</span></p><p style="text-align:left;margin-top:24px;"><span style="font-size:22px;"><strong>New construction vs. repairs</strong></span></p><p style="text-align:justify;"><span style="font-size:18px;">New construction typically involves more fee categories than a repair, including plan review, multiple trade permits, and utility or development charges. Repairs and replacements may need only a single permit, or none, depending on the city and the scope. Many Texas cities require a permit for a full roof replacement, but requirements vary, so confirm with the building department before assuming either way.</span></p><p style="text-align:left;margin-top:24px;"><span style="font-size:22px;"><strong>Common estimating mistakes</strong></span></p><ul><li><span style="font-size:18px;">Leaving out trade permits or re-inspection fees.</span></li><li><span style="font-size:18px;">Using an outdated fee schedule.</span></li><li><span style="font-size:18px;">Applying a valuation-based formula to residential work in a city where § 214.907 prohibits it.</span></li><li><span style="font-size:18px;">Assuming a rural project needs no approvals at all.</span></li><li><span style="font-size:18px;">Forgetting windstorm inspection and certification costs on the coast.</span></li></ul><p style="text-align:left;margin-top:24px;"><span style="font-size:22px;"><strong>Permit costs in insurance claims</strong></span></p><p style="text-align:justify;"><span style="font-size:18px;">When a covered repair legally requires a permit, replacement-cost estimates commonly include the permit fee as a line item. Wording matters: in <em>JAW The Pointe, L.L.C. v. Lexington Insurance Co.</em>, 460 S.W.3d 597 (Tex. 2015), the Supreme Court of Texas held that anti-concurrent-causation language barred coverage for code-upgrade costs where excluded flood contributed to the loss along with covered wind.</span></p><p style="text-align:justify;"><span style="font-size:18px;"><strong>Practical tips:</strong> print or save the city’s permit requirement for the scope of work, keep the permit application and receipt, list permit and inspection fees as separate estimate line items, and keep copies of the adopted code provisions that drive any upgrade costs.</span></p><p style="text-align:left;margin-top:24px;"><span style="font-size:22px;"><strong>Bottom line</strong></span></p><p style="text-align:justify;"><span style="font-size:18px;">Permit costs vary by city, county, and scope, and several Texas statutes limit how local governments can charge them.
